Talalai v. Cooper Tire & Rubber Co., MID-L-8839-00MT, Mass Tort 249 Law. Div.
Middlesex Cty.)
In the Cooper Tire case, the firm of Lambert and Nelson acted as co-lead counsel with primary responsibility for the liability aspects and causation issues in the case. The firm developed evidence in support of the contention that the manufacturing process of Cooper Tires resulted in trapped gases in the tire structure (matrix) which over time could lead to catastrophic tread separation and failure. In the discovery phase of the trial, the firm hired a small army of experts from around the country and from Canada who set up a temporary inspection facility in East Camden, Arkansas. That effort resulted in the inspection of literally thousands of failed and/or defective tires which formed the factual basis for proof regarding the claim. That inspection process, which lasted for weeks, as well as specialized testing utilizing state-of-the-art inspection procedures and/or equipment in the form of the L-Ray process,(where a tire is inspected by laser tomography in a vacuum) as well as the development of proof regarding production process issues, was instrumental in the resolution of the claim. The firm of Lambert and Nelson had ultimate responsibility for the liability issues which supported the resolution of the Cooper Tire matter. Kent Acosta, et al. v. Master Maintenance & Construction, Inc., et al., Civil Action No. 98-1065 and consolidated cases, Section A-2, United States District Court, Middle District of Louisiana.
This case was handled as a mass tort with the firm of Lambert and Nelson acting as lead counsel for hundreds of claimants. Through the firm’s involvement with multiple defendants and defense law firms, the matter was resolved for the benefit of the clients who were subjected to a release of mustard gas and other toxic chemicals at the Georgia Gulf Facility in Plaquemine, Louisiana. Following the resolution of the individual claims, the firm of Lambert and Nelson, and in particular its senior partner, Hugh P. Lambert, Esquire, was selected to act as a mediator for the resolution of the outstanding claims.
Gracie S. Atkins, et al. v. Harcros Chemicals, Inc. et al, Civil Action No. 89-23976 and consolidated cases, Civil District Court, Parish of Orleans. In this claim, the firm of Lambert and Nelson acted as lead counsel with the responsibility for liability, causation and the development of a class definition for a class which was ultimately certified. Following class certification, the matters moved forward with discovery conducted in large part by the firm. Ultimately, the matter was resolved following a fairness hearing held in the Louisiana Superdome which was declared by the Supreme Court of the State of Louisiana to be a courthouse for the limited purpose of conducting the fairness hearing due to the number of individuals involved. The Honorable Civil District Court Judge Frank Zaccaria, appointed by the Louisiana Supreme Court to handle this complex class action, ultimately approved the resolution and distribution of millions of dollars in damages to the class.
In the Matter of the Complaint of Unocal Thailand, Ltd. for Exoneration from or Limitation of Liability, Case No. 90-2150 KN(JRX), United States District Court for the Central District of California. This case which was handled in the early 90's by the firm of Lambert and Nelson involved the drillship Seacrest which capsized in the Gulf of Thailand during a typhoon. In that action, the firm acted as co-lead counsel on issues regarding liability and causation concerning the negligent operation of the drillship Seacrest. The firm’s efforts included trips to Thailand in order to develop the factual basis for liability based on testimony and documents produced in depositions in Bangkok. The evidence gathered included analysis of complex issues regarding side-scan sonar patterns left by anchors and debris, meteorological data, vessel stability calibrations and time lines. As a result of the firm’s efforts, its clients, who were the surviving families of the victims drowned in the catastrophe, recovered millions of dollars in damages. In that case, the firm was hired by other renowned law firms because of our firm’s unique qualifications and experience in similar claims.
Nash v. Penrod Drilling, Civil Action No. 85-5142, United States District Court for the Eastern District of Louisiana. The firm of Lambert and Nelson acted as lead counsel in the multiple party disaster resulting from the Penrod MODU (mobile offshore drilling unit) collapse during a violent hurricane which caused extensive damage. The firm was primarily responsible for the liability and causation aspects that lead to the jack–up rig collapsing into the Gulf of Mexico during the storm due to inadequate pre-loading procedures and the failure to promulgate and/or follow appropriate evacuation procedures. In addition, the firm developed evidence which lead to improved techniques, equipment, and procedures for evacuating offshore drilling rigs and platforms in an emergency. As a result of the firm’s efforts, our clients received millions of dollars in damages from the responsible parties.
ARCO Oil and Gas Co. v. Southern Natural Gas Company, et al. Civil Action No. 89-1362 and consolidate cases, United States District Court for the Eastern District of Louisiana. The firm of Lambert and Nelson acted as co-lead counsel in matters involving liability and causation. Some of the issues that the firm developed revolved around the complexities of three phase (gas, liquid, and condensate) petro chemical transmission lines from platforms in the Gulf of Mexico to shore. The firm’s efforts resulted in the assignment of liability to various responsible parties resulting in full compensation to the firm’s clients. In addition to a multi-million dollar resolution for its clients, the firm was able to accomplish a resolution of this complex litigation in approximately twelve months. It is important to the firm to accomplish a full recovery for its clients in the shortest possible time frame.
